Update for Employers: USCIS Aligns with DOL on Schedule A Group II

The US Citizenship and Immigration Services (USCIS) is making things a bit clearer for employers who are sponsoring foreign workers in science or art fields.

Here’s what you need to know:

  • Some visa applications require employers to prove that insufficiently qualified US workers are available.
  • For certain science and art jobs, employers can skip a step by showing the job is in a field where colleges offer degrees.
  • USCIS is now using the same definition of “science or art” as the Department of Labor (DOL) to avoid confusion. This means science or art includes any field where colleges offer degrees in that subject.

There are no major changes, but this clarifies the process for employers sponsoring foreign workers in science or art.
