USCIS Updates Policy Manual for Family-Based Conditional Permanent Residency

USCIS Updates: On 12 December 2023, the US immigration services and the USCIS updated its family-based conditional requirements. 

Here’s the update for  Form I-751, Petition to Remove Conditions on Residence. The updates clarify that a noncitizen’s conditional permanent resident status expires due to failure to file Form I-751 timely.

They may be eligible to adjust the permanent resident level on a new basis and can apply for Form I-485, Application to Register Permanent Residence, or Adjust Status.

According to the non-immigrant Marriage Act 1986, non-citizens who married to a citizen of the country have two years of citizenship.

They obtain permanent resident status based on marriage, and that marriage began less than two years before they obtained that status.

To remove conditions on their residence, the applicant should fill out form I-751 within 90 days of the second anniversary of obtaining conditional permanent resident status. For more information, see the Policy Update. (PDF, 316.67 KB)
